Schengen gets an Upgrade: New Rules Agreed to Bolster Free Movement, Border Security and Public Health

The European Union took a major step towards a more resilient Schengen area today, with the European Parliament and Council reaching an agreement on new rules for the Schengen Borders Code. This legislation aims to address various challenges, from irregular migration to public health emergencies, while safeguarding the principle of free movement within the bloc. “The pandemic highlighted the importance of Schengen for our economies and societies. This agreement ensures border controls are a last resort, and the proposed measures allow us to manage external borders together.”

Key features of the new Schengen rules:

• Stronger external borders: Measures to counter the “instrumentalization” of migrants by third countries, including limiting border crossing points or reducing their hours.
• Enhanced cross-border police cooperation: Encourages collaboration in border regions as an alternative to internal border controls.
• Revised reintroduction of internal border controls: Stricter rules and safeguards for imposing temporary internal borders, only as a last resort.
• New transfer procedure for irregular migrants: Facilitates returning migrants apprehended within the EU to the member state they first entered.
• Streamlined travel restrictions during health emergencies: Enables coordinated action at external borders during major public health threats.
